Not scared of Malacanang, Inc.?

Keen observers of trends cannot fail to see from the stream of events on February 24 that a “social experiment” has actually been launched by Malacanang. It consists of a scheme and scene that allow the configured political order to – arrest any person, raid any establishment, detain any individual, confiscate any item – without the requisite writ or warrant.

Proclamation 1017 declaring a state of emergency could not have come at the eve of the 20th anniversary of People Power Revolt when icons and adherents of democracy gather at EDSA for this annual affair – as a matter of cherished tradition. Ironically, February 24 turned out to be Day 1 in the week-long life of a social nightmare that were PP 1017 and General Order 5. The State was quick to accuse the personal enemies of GMA as involved in the conspiracy to grab power and take over reins of government as if PP 1017 was not a pre-meditated act.

On Day 1 alone, UP Prof. Randy David was arrested. Rally permits instantly revoked. Rep. Crispin Beltran, where found, was likewise arrested. The printing press of The Tribune newspaper was raided if placed under police control. Elements of PNP are sent out to run after targets like some mad dogs in the wilds.

Subsequent acts of Malacanang betrayed the lifting of PP 1017, however farcical. The party-list representatives, seeking asylum at the House of Representatives, will be subjected to immediate arrest as soon as they sneak out of the complex. True enough, Rep. Risa Hontiveros-Baraquel was arrested on sight while celebrating International Womens’ Day.

Malacanang does a back-to-back policy approach. Even with PP 1017 lifted, it announced manhunt of Sen. Gringo Honasan and cash bounty for his early capture. The Magdalo mutineers who escaped are now fugitives from justice. A secret list of so-called ‘destabilizers, coup plotters, communists’ is still withheld but being dangled to send shark-attacks-effects to all swimmers in our political beach.

The nipped-in-the-bud tale of a coup plot triggering issuance of PP 1017 is anectodal altogether. The token claim of a ‘clear and present danger’ as concocted by ISAFP is cheap tale for an organization with serious credibility problem since the Garci wiretapping case. Such a claim issued as Gospel truth has no two legs to stand on.

The situation-less arrest without warrant of former Sec. Dinky Soliman is symptomatic of an emerging pattern of rule of men than of law. The grand social experiment, given its excesses and borderless authority has given rise to a new phenomenon – police supremacy, call it that. Nowhere in the Constitution, past or present, is police supremacy enshrined.

An emerging ‘catchbasin approach’ in governance is being operationalized with the PNP and the AFP as the political apparatus to – suppress, repress, and oppress – the citizens that they are supposed to protect. Anybody who may be suspected or tagged of being a ‘destabilizer, coup plotter, oppositionist’ will be the PNP’s next victim.

There is an evolving situation making any citizen a prey and every policeman a predator. This prey-predator is a scheme of things devoid of any conceivable basis in the Constitution. The rule of men phenomenon is fast emerging with PNP found in every street corner to enforce the law based on his own individual judgment. Since when did we entrust matters of law to the ordinary policeman? Who will police the Police?

It is disconcerting to think that the PNP can just arrest Cong. Beltran and Cong. Virador or the remaining pack of party-list representatives anywhere they are seen. Now, PNP pays cash bounty to any information by an informant leading to the arrest of Sen. Gringo Honasan. It is unsetting to know that neither the House nor the Senate has to cry wolf with the imminent arrest of their Members when its institutional independence is being violated.

In many instances than just few, well-documented statements from the mouth of DOJ Sec. Raul Gonzales indicate to us that he has usurped his powers and authority under the Constitution to become – the law, the judge, and the executioner – all in one. No wonder, the IBP has contemplated charging him with criminal, civil and administrative culpability for his all-consuming political grandstanding – a nemesis to every legal practitioner.
